A 2007 amendment to Maryland workers' compensation law allowed dependents of certain public safety employees and firefighters to collect retirement benefits and workers' compensation benefits in instances when the decedent employee died as a result of an occupational disease. Those dependents were entitled to collect such benefits up to the amount of the decedent employee's weekly salary at the time of death. In this case, the Maryland Court of Appeals concluded there was not sufficient evidence to show that the legislature intended for the amendment to apply retroactively.
